Terms & Conditions
1. Definitions
“We”, “us”, “our” refers to Carnaby Creative Limited. “You”, “your” refers to the user of our website or purchaser of our services. “Platform” refers to the Carnaby Creative website and e-learning system. “Course Content” refers to all training materials, educational resources, videos, assessments, and any other content delivered through our platform.
2. Account Registration
To access our e-learning courses, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration.
3. Course Access and Duration
Upon purchase, you are granted access to your enrolled course(s) for a period of 3 months from the date of purchase, unless otherwise specified. Access may be extended or renewed at our discretion. After the access period expires, you will no longer be able to view course materials, though your certificate of completion (if earned) will remain available.
4. Pricing and Payment
All prices are displayed in pounds sterling (GBP) and are inclusive of VAT where applicable. Payment is processed securely via Stripe. We reserve the right to change our pricing at any time, but changes will not affect existing purchases.
For organisational bulk purchases, pricing is based on volume. The more seats purchased, the greater the per-seat discount. Contact us for a quotation for large orders.
5. Refunds
For full details on our refund policy, including product-specific terms and cancellation schedules, please see our Refund Policy.
6. Account Sharing and Credential Misuse
Each account is for individual use only. Sharing your login credentials with others is strictly prohibited and constitutes a breach of these Terms. If we detect that an account is being used by multiple individuals, we reserve the right to immediately suspend or terminate your access to the platform without a refund being issued.
For organisations requiring multiple users, please use our bulk purchase facility, which provides individual accounts for each learner with full administrative oversight.
7. Intellectual Property and Course Content
All Course Content remains the exclusive property of the relevant company within the Carnaby Group. All intellectual property rights, including copyright, database rights, design rights, trademarks, and all other proprietary rights in the Course Content vest solely in us and are expressly reserved.
Subject to full payment of all applicable fees, you are granted a limited, personal, non-exclusive, non-transferable, and revocable licence to access and use the Course Content solely for your own internal, educational, or professional development purposes.
The Course Content must not, without our prior written consent, be:
- Copied, reproduced, recorded, stored, adapted, translated, or modified
- Shared, distributed, transmitted, sublicensed, or sold to any third party
- Published, uploaded, displayed, streamed, or made available online or offline
- Incorporated into other training, courses, products, services, or commercial offerings
- Used to create derivative works or competing materials
Any unauthorised use, reproduction, or distribution of the Course Content constitutes a material breach of these Terms and may result in immediate suspension or termination of access, without prejudice to our right to take legal action.
8. Certificates
Certificates of completion are issued upon passing the final assessment for a course. Certificates include an expiry date and should not be treated as a permanent qualification. The training content is regularly updated to reflect current standards, and we encourage learners to re-certify when their certificate expires.
9. Limitation of Liability
Our courses are designed for professional development and educational purposes. They do not constitute clinical advice. We accept no liability for any actions taken or decisions made on the basis of our training content.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
